Buyer Terms and Conditions
I pride myself on delivering the highest standard of Artwork and professionalism. Please read the terms and conditions below before placing your order to ensure your interests are protected.

By using the website and placing an order, you (the buyer, referred to as “you” in these Buyer Terms and Conditions) agree to our terms and conditions, thereby entering into a legally binding agreement with Affordable Studio Art.

From time to time, we may change these Terms and Conditions. It is your responsibility to check the applicable Terms and Conditions at the time of your order.

Definitions
Order Confirmation: An email from Affordable Studio Art confirming the buyer’s order, including details of what the Artist has agreed to supply, the price, and the expected delivery/supply date.
Commissions: Artwork created according to the buyer’s requirements, such as specific subject matter or color variations. A non-refundable 50% deposit is required in advance, with the balance payable upon the buyer’s approval of the images.

Intellectual Property Rights: Affordable Studio Art holds the copyright to any commissioned artwork. Sculpture commissions are on a pick-up-only basis.

Standard Delivery: Delivery within Mainland UK using a carrier approved by us, insured to at least the value of the sale price of the Artwork being sent, with a signature obtained upon delivery.

Working Days: Any day Monday to Friday from 9 am to 5 pm, excluding all public and bank holidays in England and Wales.

Price and Payment
The Price includes standard delivery within Mainland UK. Carrier details will be provided in your dispatch email. Outside Mainland UK – will be charged.
Additional charges apply for non-standard delivery based on address, size, and weight of the Artwork.

Payment is made according to the order process on the Website, which outlines the current accepted methods of payment. By using any payment method, you confirm that all order information is true and accurate and that you are authorized to use the payment method.

We may reserve Artwork for you with a non-refundable 10% deposit. The balance payment is due before dispatch.
If not paid, the Artwork will be offered for sale to others, and your deposit will not be refunded.
You are responsible for payment once an order is placed. If payment is not received when due, we reserve the right to charge up to 15% interest per month (or part thereof) on unpaid amounts and recover reasonable expenses incurred in obtaining payment.

Delivery
Delivery is arranged to the address provided in the Order Confirmation.
Sculpture commissions are pick-up only unless otherwise arranged.
Delivery times are estimates and not guaranteed. Free UK shipping applies to addresses in Mainland UK only; extra charges apply for other services or addresses outside Mainland UK.
Multiple pieces of Artwork may be dispatched individually.

Affordable Studio Art offers various delivery options, but these may be limited based on the Artwork type or shipping destination. Contact us for queries about shipping.

You are responsible for providing accurate delivery information and making arrangements to receive the Artwork. If delivery is attempted and arrangements are not made, additional delivery charges may apply.

Delivery usually requires a signature (someone aged 18 or over). Your signature confirms receipt and the state of the package.
Upon receiving your order, examine the package and Artwork for damage. If damaged, sign for the parcel as ‘Received Damaged’ and email us.

Consumer Cancellation Rights
This clause applies if you are a Consumer and wish to exercise your Consumer cancellation rights.
To return your order, notify Affordable Studio Art in writing within 7 days of receiving your order. Artwork must be returned unused, in perfect condition, with the original packaging, within 14 days of cancellation notification, at your expense.

Use a service providing proof of sending. Repackage the Artwork securely and remove all shipping labels.
We may deduct an amount from your refund if the Artwork’s value is diminished due to handling beyond what is necessary to establish its nature, characteristics, and function.
Refunds will be processed within 14 days of receiving the Artwork or evidence of return.
Faults, Problems with Your Order, and Returns
For issues with your order, we may ask you to send photos of the damaged Artwork and packaging.
Within 14 days of receiving faulty Artwork, we/the Artist will either replace or repair it.

Limitation of Liability and Indemnity
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury resulting from our negligence or that of our employees or agents.
We are not liable for any indirect, incidental, or consequential loss or damage, including economic loss or loss of profit or business, howsoever caused.
Your remedies for our breach of these Terms and Conditions are limited to damages, not exceeding the price of the Artwork.

You will indemnify us against all claims, costs, and expenses arising from your breach of these Terms and Conditions.
